Terms of service

1. Who we are

The service is provided by Nexoora, email [email protected]. The client is the person or business that orders a plan.

2. The service

Nexoora builds a custom website according to the selected plan and, while the subscription is active, keeps it online with hosting, an SSL certificate, weekly backups, security and system updates, an editing dashboard and the plan's monthly changes. The website is a service: the client has the right to use it while the subscription is active.

3. Pricing and payment

Prices, currency and what each plan includes are shown on the plans page and in the order summary. The setup fee is paid when ordering. The monthly plan, add-ons (professional email and domain) and new pages or features are charged as shown in the order or quote. Payments are processed by Stripe on the saved card. Prices do not include taxes that local law requires.

4. When the monthly plan starts, and renewal

The monthly plan starts when the site is published and renews automatically every month until canceled. If the site is not published within 12 months of the setup payment, the monthly plan is charged from that date.

5. Launch price

Clients who sign up at a launch price keep the plan's monthly price while the subscription stays active and no payment is more than 30 days late. Canceling and coming back later means paying the price in force on that date. This does not apply to add-ons or one-off services.

6. Timelines, briefing and approval

The plan timeline (3 to 7 business days for the Mini site and 5 to 14 business days for the Business website) counts from the completed briefing, including the information and material we need. The client has 7 business days to respond to each preview; if there is no reply, the preview is considered approved. Revisions are unlimited until approval, within the scope of the briefing; scope changes receive a quote.

7. Monthly changes

A change is a one-off update (text, photo, section or color). Unused credits roll over up to the plan limit. New pages or features get a separate quote.

8. Ownership

The client owns what the client provides (text, photos, logo and brand) and the domain. The site system (dashboard, base code and extensions) belongs to Nexoora and is licensed to the client while the subscription is active. After 12 paid months, the client becomes the owner of the site's design (layout, styles and artwork created for them) and, on cancellation, receives a static copy of the site with that design; the system is not part of the copy. Before 12 months, on cancellation the site goes offline and the client keeps the domain and the content. The client allows Nexoora to show the site in its portfolio and may ask for its removal at any time.

9. Domain and email

The domain is registered in the client's name, and the client is the registrant. The monthly domain fee covers registration, renewal, DNS, pointing to the site and help with transfers. On cancellation, Nexoora provides the transfer code within 5 business days; after the last paid period, renewal becomes the client's responsibility. Email inboxes follow the subscription and stop working when it ends; the client may export messages beforehand.

10. Client content

The client declares having the right to use the content they send and is responsible for it. Nexoora may refuse content that is illegal or violates third-party rights.

11. Availability and security

Nexoora uses reasonable efforts to keep the site online and secure but does not guarantee uninterrupted operation or the absence of faults or attacks. Scheduled maintenance is announced when possible.

12. No guarantee of results

Nexoora does not guarantee Google ranking, traffic, leads or sales. Those results depend on outside factors.

13. Cancellation

The client can cancel at any time, with no penalty and no long-term contract, by email or from the site's dashboard. Cancellation takes effect at the end of the period already paid, and there is no prorated refund of the monthly plan. The site stays online until that day. Within 30 days afterward, Nexoora gives the client the site's text and images and help with the domain transfer.

14. Withdrawal and refunds

The client may withdraw within 7 days of ordering and receive a full refund of the setup fee. Where Brazilian consumer law applies, this follows article 49 of the Consumer Defense Code. The setup fee is also refunded if Nexoora fails to deliver the first version within the plan's maximum timeline for reasons attributable to Nexoora.

15. Late payment and suspension

If the monthly payment is late, Nexoora notifies the client by email and, after 7 days, may suspend the site with no data loss until payment is settled. If the delay exceeds 60 days, the site is removed and a copy of the data is kept for 30 days. Disputing a card charge without contacting Nexoora first authorizes suspension.

16. Liability

To the extent allowed by law, Nexoora's total liability is limited to the amount the client paid in the 12 months before the event and does not include lost profits. Nothing here limits rights that consumer law gives consumers.

17. Privacy

Information provided is used to deliver the service, register the domain, process payments and comply with the law. Processors include Stripe, the hosting provider and Cloudflare.

18. Changes

Nexoora may change these terms and prices with 30 days' notice by email; clients who disagree can cancel before the change takes effect.

19. Governing law and disputes

For consumers in Brazil, Brazilian law and the consumer's home court apply. Disputes with clients in other countries are resolved by individual arbitration conducted online, without limiting the right to bring small claims in a competent court.
